Part I – Sugarcane Restaurant
1. Reservations
• Reservations may be made by telephone, by email, or through the Restaurant's online booking system.
• A reservation made through the online booking system is confirmed automatically by the system; a reservation made by email is confirmed by a reply email from the Restaurant. A reservation made by telephone is confirmed verbally at the time of the call and is not followed by a separate email confirmation.
• The Restaurant may request the number of guests, date, time and any special requirements (e.g. dietary restrictions or allergies) at the time of booking.
2. Card Authorisation and Deposit Policy for Group Reservations
• For reservations of 12 (twelve) or more guests, the Restaurant will place a pre-authorisation hold on the guest's payment card at the time of booking, in the amount of US$20 per person.
• Where the reservation is honoured (i.e. the group attends as booked), the hold is not charged. Release of the hold is handled by the guest's card issuer and may take more than 48 hours, depending on the guest's bank, public holidays, weekends and other factors outside the Restaurant's control.
• Where the group does not attend the reservation (“no-show”), or cancels the reservation less than 6 hours before the reserved time, the held amount of US$20 per person will be charged (captured) from the guest's card. The 6-hour period is measured from the reserved time itself – for example, for a reservation at 6:00 p.m., a cancellation must be made before 12:00 p.m. (noon) the same day to avoid the charge.
• For reservations of 12 (twelve) or more guests, where fewer guests attend than the number originally booked (a partial no-show), no fee is charged provided the shortfall does not exceed 50% of the originally booked party size. Where the shortfall exceeds 50% of the originally booked party size, the US$20 charge applies to each guest who does not attend.
• For example: for a reservation of 12 guests where 9 attend (a 25% shortfall), no fee is charged. For a reservation of 12 guests where only 4 attend (a shortfall of more than 50%), a fee of US$20 is charged for each of the 8 guests who did not attend (US$160 in total).
3. Events and Ticketed Entry
• Where the Restaurant hosts a special event (e.g. a themed dinner, party or ticketed function), entry may be conditional on the purchase of a ticket or payment of a cover charge in advance or upon arrival, in US Dollars (USD) only.
• Payment for event entry is separate from, and not related to, the card authorisation and deposit policy described in Section 2.
• Event tickets are transferable to another person but are non-refundable.
4. Rights and Obligations of the Restaurant Guest
• The guest must inform the Restaurant of any dietary restrictions or allergies at the time of booking or as soon as possible thereafter.
• The guest is responsible for the conduct of their group during the reservation or event and for any damage caused to Restaurant property.
• A reserved table is held for 15 minutes after the reserved time; after that period the Restaurant may release the table to the next group on the waiting list. Where a group arrives after this period and another suitable table is available, that table will be offered to the group instead. No cancellation fee applies in these circumstances.
• A smart casual dress code applies at the Restaurant and at its events.
• Well-behaved and trained pets are allowed at the Restaurant, subject to these Terms and any house rules posted at the Restaurant. The guest is responsible for their pet's behaviour and for any damage or additional cleaning caused by the pet.
5. Rights and Obligations of the Restaurant
• The Restaurant will make reasonable efforts to accommodate dietary requirements notified in advance.
• The Restaurant reserves the right to reasonably reassign seating within a reservation where required by operational needs.
• The Restaurant reserves the right to refuse service in the event of a serious breach of these Terms or of applicable house rules.
Part II – Sugarcane Sports Club
6. Membership
• Current membership categories, durations and fees are published and kept up to date on the Club's website at www.sugarcane.vg.
• Membership fees are payable in US Dollars (USD), either online by credit/debit card or in cash at a time pre-arranged with the Club manager (tel. +1 (284) 540 5455).
• Membership entitles the member to use the specific court(s) or facilities corresponding to the membership type purchased, as set out on the Club's website, subject to these Terms and any house rules posted at the Club.
• Membership is personal to the member and is non-transferable.
• Membership fees are non-refundable.
• Membership is available for a duration selected by the member at the time of enrolment, ranging from 1 month to 12 months, and may be renewed on the terms in force at the time of renewal.
7. Court Reservations and Payment
• Court reservations may be made through the Club's mobile application or website only; reservations cannot be made by telephone or in person.
• Each reservation is made for a specific date, time and court. Every player using a court must be covered by an active reservation for that court.
• Payment for a court reservation, where applicable, is payable in US Dollars (USD), either online by credit/debit card or in cash at a time pre-arranged with the Club manager (tel. +1 (284) 540 5455).
• Court reservations may be made for any available time slot shown in the Club's mobile application or website, including on the day of play.
• A single court reservation may cover a maximum of 3 hours of court time.
• Cancellation is free of charge where made at least 2 hours before the reserved time. Cancellations made less than 2 hours before the reserved time, and no-shows, may be charged in full at the applicable court fee.
• The Club reserves the right to limit the number of reservations per member within a given period.
8. Rights and Obligations of Club Members and Guests
• A smart casual dress code applies at the Club. Members and their guests must comply with the Club's house rules while using the facilities.
• Well-behaved and trained pets are allowed at the Club, subject to these Terms and any house rules posted at the Club. The member is responsible for their pet's behaviour and for any damage or additional cleaning caused by the pet.
• A member is responsible for the conduct of any guest they bring to the Club and for any damage caused by themselves or their guest to the Club's equipment or facilities.
• Guests do not receive free use of the Club's courts under any membership type; a guest may only use a court if covered by their own active booking. A guest of a member holding a Single membership may be granted an exception to this only where pre-arranged with the Club manager.
• Members and guests must vacate a reserved court promptly at the end of the reserved session to allow the next reservation to proceed.
9. Rights and Obligations of the Club
• The Club will maintain its facilities and equipment in good working order.
• The Club may close a court or other facility temporarily for maintenance, resort events or safety reasons, and will give reasonable notice of any such closure where practicable.
• The Club reserves the right to refuse admission or suspend membership in the event of a serious or repeated breach of these Terms or the Club's house rules.
Part III – Delivery, Cancellation, Refunds, Disputes and Privacy
10. Delivery of Services
• Sugarcane provides services (dining, events, Club membership and court use), not physical goods; nothing is shipped. Services are delivered at the Restaurant and the Club at Saba Rock Resort.

• The Club may close a court or facility temporarily for maintenance, resort events or safety reasons (see Section 9).
11. Cancellation Conditions

• Event tickets and Club membership fees are non-refundable (see Sections 3 and 6).
• Club court reservations cancelled at least 2 hours before the reserved time are free of charge (see Section 7).
• Where a refund is due under these Terms, it is returned using the original payment method where possible. Processing times may vary depending on the issuing bank or card provider.
13. Complaints and Dispute Resolution
• A guest or member who is not satisfied with the services should raise the matter with Sugarcane as soon as possible, so that it can be remedied, and may also submit a complaint using the contact details at the beginning of these Terms.
• Sugarcane will review each complaint and will endeavour to resolve it amicably.
• Out-of-court dispute resolution: where a dispute with a consumer arising from the contract is not resolved by complaint or by agreement, the consumer may submit a proposal for out-of-court resolution of the dispute to the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI), the competent alternative dispute resolution body: Česká obchodní inspekce, Ústřední inspektorát – oddělení ADR, Štěpánská 796/44, 110 00 Praha 1, Czech Republic; website: adr.coi.cz; email: adr@coi.cz; telephone: +420 296 366 360. The proposal may be submitted within one year of the date on which the consumer first asserted the disputed right with the Company.

14. Privacy and Data Protection
• The Company collects the personal data that guests and members provide when making reservations, enrolling in membership or booking courts, such as name, contact details, booking details, special requests and payment information.
• Personal data is used to process and manage reservations, memberships and payments, provide the booked services, communicate with the guest or member and comply with legal obligations.
• The Company does not disclose personal data to third parties, except to service providers engaged to provide the services (e.g. payment processors and booking system providers), who may use it only for those services, or where required by law.
• Personal data is kept only for as long as necessary to provide the agreed services and to meet legal obligations.
• The Company maintains physical, electronic and administrative safeguards to protect personal data from unauthorised or inappropriate access.
• A guest or member may request to review, update or correct their personal data by written request to the Company, using the contact details at the beginning of these Terms.

• The Company's handling of personal data is described in Section 14.
• These Terms are governed by, and shall be construed in accordance with, the laws of the British Virgin Islands. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the British Virgin Islands.
